We'll get the update. That lawsuit could last for years and by the time it's decided, it will be appealed. Look at Dish and Tivo. Suing is easy, getting it out of the courts for good is yet another thing.

Only hope when it's over, we are still left with enough to like our phones! Apple lost hard to Microsoft, how fierce will this fight be? The Mac aps already kill Google's. What if they win enough rights to kill the Android Market? Hope not! When this phone does what I want it to, I love it! But the iPhone apps are still so much cleaner! Will we get a firmware update in time to enjoy it, or will we be screwed by the courts to have nothing by the time any update comes out?

I have no worries. By the time this lawsuit is settled I will be on another phone. Also, this suit will most likely be about HTC paying Apple money.

After the district court ruled in favor of Microsoft, Apple appealed the decision arguing that the district court only considered infringements on the individual elements of Apple's GUI, rather than the interface as a whole. The appeals court almost entirely affirmed the ruling of the district court, establishing that, "almost all the similarities spring either from the license or from basic ideas and their obvious expression... illicit copying could occur only if the works as a whole are virtually identical."[1] However, the circuit court did reverse the district court's decision not to award attorney's fees to Microsoft, clarifying and sending the case back to the district court to resolve the issue.
